The service, features, and pricing described here may change as we work with design partners. We will give active accounts notice of any material change via email and publish the new effective date at the top of this page.
Who these terms are for
These terms apply to licensed real estate agents and brokerages who use PastClient.ai ("PastClient", "we", "us") to engage the past clients already in their book of business. By creating an account, you agree to these terms on behalf of yourself and any team members you add.
What you can use PastClient for
PastClient is built for ongoing engagement with people who have already closed a transaction with you — past clients, past co-brokered transactions, and direct sphere contacts where you have a documented relationship. You may use the service to send SMS, email, and (with PEWC) AI voice outreach to these contacts in compliance with applicable law, including the TCPA, CAN-SPAM, CASL where relevant, and state-by-state telemarketing and recording statutes.
What you cannot use PastClient for
- Cold outbound to people who are not your past clients or documented sphere.
- List rental, list purchase, scraped contact data, or appended phone numbers from third-party prospecting databases.
- Mass commercial messaging that would violate the TCPA, CAN-SPAM, the National DNC Registry, or any state-level DNC or telemarketing rule.
- Loan, mortgage, insurance, debt-relief, or other regulated solicitations outside the scope of your real estate license without separate authorization.
- Messaging that impersonates another agent, brokerage, or government agency, or that is materially misleading.
- Reselling, sublicensing, or white-labeling the service without a written agreement.
Compliance is your responsibility
You attest that you have a lawful basis — typically an Established Business Relationship plus, for AI voice, prior express written consent — to contact every past client you upload. PastClient provides tools to help you stay compliant: DNC scrub on a 31-day cycle, automatic cross-channel opt-out propagation within 10 business days, PEWC capture at intake, AI-call disclosure, and per-state recording-consent gating. These tools assist you; they do not replace your judgment, your broker's policies, or counsel. The agent owns the contact relationship and the legal exposure that goes with it.
Pricing and billing
- Solo — $59 / month, up to 100 past clients, SMS and email, voice on opt-in.
- Pro — $129 / month, up to 1,000 past clients, AI voice included.
- Team — from $499 / month platform fee plus declining per-seat pricing.
No annual contract, no setup fee. You can cancel from Settings at any time; cancellation takes effect at the end of your current billing period. Telephony usage (SMS, voice minutes, A2P 10DLC carrier fees) is passed through at cost on Pro and Team plans and itemized on your invoice.
AI-generated content
Drafts produced by PastClient's AI are suggestions, not outbound messages. Every draft must be reviewed and approved by a human on the agent account before it is sent. Once you approve a send, you take responsibility for the content as if you authored it yourself: the message goes out under your identity, your phone number, your sender, and your A2P 10DLC registration.
AI may occasionally produce inaccurate, outdated, or contextually wrong output. Treat drafts as starting points and edit anything that looks off.
Service limits and fair use
Each tier has rate limits on sends, AI voice minutes, and enrichment lookups. We may throttle traffic that risks carrier filtering, A2P campaign suspension, or sub-processor abuse. We do not allow scraping the product, reselling enrichment data, or using PastClient as a pass-through for bulk messaging infrastructure.
Termination
Either side can end the relationship at any time. You can cancel and export your past-client and outreach data from Settings before deletion. We can suspend or terminate accounts that violate these terms, generate carrier complaints, miss payment, or pose legal risk to other customers; we'll give you reasonable notice and the chance to export your data unless the violation is severe enough that immediate action is needed.
Liability
[Placeholder — to be reviewed by counsel before general availability.] To the maximum extent permitted by law, PastClient's aggregate liability for claims arising out of or related to the service is capped at the amounts you paid us in the trailing twelve months. We do not exclude liability that cannot be excluded under applicable law.
Dispute resolution
[Placeholder — to be reviewed by counsel before general availability.] Disputes will be resolved by binding arbitration on an individual basis in a venue and under the law to be specified in the final terms. The final terms will include carve-outs for small-claims and injunctive relief.
